1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website agentberttraining.com and the online course subscription services offered by Agent Bert Training (“Company,” “we,” “us,” or “our”). By accessing the Site or purchasing a subscription, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
These Terms apply to all visitors, registered users, and subscribers.
2. Eligibility
You must be at least 18 years of age to use this Site or purchase a subscription. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We do not knowingly allow minors to create accounts or purchase subscriptions.
3. User Accounts
3.1 Account Registration
To access course content, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the confidentiality of your username and password
- Notify us immediately of any unauthorized access to your account
- Be solely responsible for all activity that occurs under your account
3.2 One Account Per User
Each subscription is for a single named user. You may not share your account credentials, transfer your account, or allow any other person to access your account or course content.
4. Subscriptions and Payment
4.1 Subscription Model
Course access is provided on a month-to-month subscription basis. Your subscription will automatically renew each month until you cancel.
4.2 Billing
All subscription fees are billed monthly on your subscription start date. Payment is processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the applicable subscription fee each billing cycle.
4.3 Price Changes
We reserve the right to adjust subscription pricing at any time. We will provide you with advance notice of any price changes. Continued use of the subscription after the price change takes effect constitutes your acceptance of the new price.
4.4 Taxes
You are responsible for any applicable taxes associated with your subscription purchase.
5. Refund Policy
We offer a 7-day money-back guarantee. If you are not satisfied with your subscription, you may request a full refund within 7 calendar days of your original purchase date, subject to the following conditions:
- Refund requests must be submitted via email to: contact@agentberttraining.com
- The request must be received within 7 calendar days of the original purchase date
- Upon approval of a refund, your account and access to all course content will be immediately canceled
- Refunds apply to the initial purchase only — subscription renewal periods are not eligible for refunds
- Approved refunds will be returned to the original payment method and may take 5–10 business days to appear
We reserve the right to deny refund requests that do not meet the above criteria or that indicate abuse of this policy.
6. Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at contact@agentberttraining.com. Upon cancellation:
- Your subscription will remain active through the end of the current billing period
- You will not be charged for subsequent billing cycles
- Access to course content will cease at the end of the billing period
- Cancellation does not entitle you to a refund unless you are within the 7-day refund window described in Section 5
7. Course Content and Intellectual Property
7.1 License
Upon active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view course content for your personal, non-commercial educational use only.
7.2 Restrictions
You may not:
- Download, copy, reproduce, distribute, or publicly display course content
- Share, sell, sublicense, or otherwise transfer course access to any third party
- Record, screenshot, or capture course videos or materials
- Use course content for commercial purposes without our prior written consent
- Reverse engineer or attempt to extract the underlying code or materials of the Site
7.3 Ownership
All course content, materials, branding, logos, and intellectual property on this Site are owned by or licensed to Agent Bert Training and are protected by applicable copyright, trademark, and intellectual property laws.
8. User-Generated Content (Forums and Questions)
Our Site includes a community forum and a question submission feature. By submitting content to these areas, you:
- Grant us a non-exclusive, royalty-free, perpetual license to use, display, and moderate that content
- Represent that your content does not infringe any third-party rights
- Agree not to post content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable
- Understand that we reserve the right to remove any content at our sole discretion without notice
You are solely responsible for any content you post. We do not endorse user-generated content and assume no liability for it.
9. Embedded Third-Party Content
Course videos are hosted and embedded via Vimeo. Your interaction with embedded video content may be subject to Vimeo’s Terms of Service and Privacy Policy. We are not responsible for the practices or content of third-party platforms.
10. Prohibited Conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any portion of the Site or other user accounts
- Introduce malware, viruses, or other malicious code to the Site
- Interfere with or disrupt the Site’s operation or servers
- Scrape, spider, or harvest data from the Site without written permission
- Impersonate any person or entity
11. Disclaimers
THE SITE AND COURSE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
Course content is provided for educational and informational purposes only. We make no guarantees regarding specific results, outcomes, or income from applying information learned through our courses.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENT BERT TRAINING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR COURSE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Agent Bert Training and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Alabama, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration in Lauderdale County, Alabama, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date and, where appropriate, by email. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
16. Termination
We reserve the right to suspend or terminate your account and access to the Site at our sole discretion, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, indemnification, and limitation of liability — shall survive.
